Financial Settlements

Deciding how the financial assets of a marriage or civil partnership are to be distributed can often result in greater hostility and dispute than that created by the actual divorce proceedings.  As every marriage is different there are no strict rules as to the division of assets on divorce. The law is very flexible and has to be adaptable to take into account all of the circumstances of the case in question. It is not always the case that an equal division of the assets would be appropriate. In determining the division the court take into account a wide range of factors such as the welfare of any children of the marriage, income and capital needs and the length of the parties' marriage to name just a few.
